These terms are the agreement between you and Trailwind Endurance when you use this website. By using the site or registering for a race, you agree to them.
01Acceptance of Terms
By accessing trailwindendurance.com, joining the waitlist, or registering for a Trailwind event, you agree to these Terms of Service and our Privacy Policy. If you don't agree, please don't use the site or enter the series.
02Eligibility
You must be at least 18 years old, or have the consent and supervision of a parent or legal guardian, to register for a race. You are responsible for making sure you are healthy and physically able to take part.
03Assumption of Risk & Release
Swimming, cycling, and running — especially on gravel and in open water — involve inherent risks, including serious injury. You take part voluntarily and at your own risk. You are solely responsible for choosing safe routes and conditions, obeying all traffic and property laws, wearing appropriate safety equipment, and deciding whether you are fit to participate. To the fullest extent permitted by law, you release Trailwind Endurance, its organizers, and partners from any claims arising out of your participation. We strongly recommend consulting a physician before starting any training or racing.
04Your Content & Submissions
When you submit results, routes, photos, or other content, you grant Trailwind a non-exclusive, worldwide license to use and display that content. You keep ownership of your content and are responsible for having the right to share it.
05Prohibited Conduct
- Submitting false, manipulated, or another person's results.
- Interfering with the site, its security, or other athletes' use of it.
- Using the site or series for any unlawful purpose.
06Intellectual Property
The Trailwind name, logo, content, and design are owned by Trailwind Endurance and protected by law. You may not copy, reproduce, or use them without our written permission.
07Third-Party Services & Links
The site relies on and links to third-party services. We are not responsible for those services, and your use of them is governed by their own terms and policies.
08Disclaimers
The site and series are provided "as is" and "as available," without warranties of any kind, whether express or implied. We do not guarantee the site will be uninterrupted, error-free, or secure.
09Limitation of Liability
To the fullest extent permitted by law, Trailwind Endurance will not be liable for any indirect, incidental, or consequential damages, or for any injury or loss arising from your participation in the series or use of the site.
10Indemnification
You agree to indemnify and hold harmless Trailwind Endurance and its partners from any claims, damages, or expenses arising out of your participation, your content, or your violation of these terms.
11Changes to the Series or Terms
We may update the series, the site, or these terms at any time. When we change these terms, we'll revise the "Last updated" date above. Continuing to use the site after changes means you accept them.
12Governing Law
These terms are governed by the laws of the United States and the state in which Trailwind Endurance operates, without regard to conflict-of-law rules.
